These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Vanquish Inc., a Maryland corporation ("Vanquish," "we," "us," or "our"), governing your access to and use of the AllergyGuardAI mobile application and related services (collectively, the "Service").
By downloading, installing, or using AllergyGuardAI, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not access or use the Service.
We reserve the right to update these Terms at any time. Continued use of the Service following notification of changes constitutes acceptance of the revised Terms.
AllergyGuardAI is an AI-powered mobile application designed to assist individuals and families in identifying potential food allergens in restaurant menus, packaged food products, and related food items. The Service provides the following features, which may vary by subscription tier:

AllergyGuardAI has not been reviewed, approved, cleared, or authorized by the U.S. Food and Drug Administration (FDA) or any other regulatory authority as a medical device or medical application. The Service must not be used as a substitute for professional medical advice, diagnosis, or treatment.
The allergen analysis provided by AllergyGuardAI is generated by artificial intelligence based on available ingredient information and may not reflect actual food preparation methods, cross-contamination risks, recipe changes, supplier changes, or kitchen practices at any specific restaurant or food manufacturer. Vanquish Inc. makes no representation or warranty that any food item identified as safe by the Service is in fact free of allergens.
You acknowledge and agree that:
The EpiPen expiry tracking feature is provided as a convenience reminder only. Vanquish Inc. is not responsible for missed notifications due to device settings, notification permissions, app updates, or any other technical or non-technical factors. You are solely responsible for monitoring and maintaining your emergency medications.
To access certain features of the Service, you must create an account using a valid email address and password, or through supported third-party authentication providers. You agree to provide accurate, current, and complete information during registration and to maintain the accuracy of such information.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@allergyguardai.app of any unauthorized use of your account.
You may delete your account at any time through the Settings section of the app. Upon deletion, your account data will be permanently removed from our systems within thirty (30) days, subject to any data retention obligations required by law.
AllergyGuardAI offers a free tier with limited features including a restricted number of menu scans per month and a single allergy profile. The free tier does not require payment information.
Premium subscription plans are available on a monthly or annual basis at the prices displayed within the application at the time of purchase. Premium features include unlimited scans, multiple family profiles, and additional functionality as described in the app.
Premium subscriptions are billed in advance on a recurring basis through the applicable app store platform (Apple App Store or Google Play Store). Subscriptions automatically renew unless canceled at least twenty-four (24) hours before the end of the current billing period.
Refund requests are subject to the refund policies of the applicable app store platform through which the subscription was purchased. Vanquish Inc. does not independently process subscription refunds.
We reserve the right to modify subscription pricing at any time. We will provide reasonable advance notice of price changes through the app or by email.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
The Service, including all content, features, functionality, software, text, graphics, logos, and other materials, is owned by Vanquish Inc. and is protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your personal, non-commercial purposes in accordance with these Terms.
AllergyGuardAI uses third-party services to provide certain features, including but not limited to:
Vanquish Inc. does not warrant the accuracy, completeness, or reliability of data provided by third-party sources. Product ingredient information retrieved from third-party databases may be incomplete, inaccurate, or out of date.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
VANQUISH INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. VANQUISH INC. DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY ALLERGEN ANALYSIS OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VANQUISH INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO:
IN NO EVENT SHALL VANQUISH INC.'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO VANQUISH INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
You agree to indemnify, defend, and hold harmless Vanquish Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Maryland.
Vanquish Inc. reserves the right to modify, suspend, or discontinue the Service or any portion thereof at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
AllergyGuardAI includes an Emergency Mode feature designed to provide quick access to allergy profile information and general guidance during potential allergic reactions. By using the Emergency Mode feature, you acknowledge and agree to the following:
